Divorce is among the most traumatic ordeals a person can experience. Not only is it emotionally draining, it is also legally complex and cumbersome, especially in India, with its unique mix of diversity – religious and social – and conservativeness.
A standard divorce takes about a year, but particularly intractable cases can go on for several years. ‘The process of filing a petition for divorce and the procedure to adjudicate it is like any other court case. Strictly speaking, you don’t need a lawyer to file a divorce petition or appear in court on your behalf,’ says Delhi-based lawyer Aly Mirza.
